Gun rights restoration, in general

A general explanation of pardon, expungement, set-aside, and relief from disabilities. This page does not state the law of any state.

Not a law firm; not legal advice.

State-specific rules are not published on this page. Nothing here is the statute of a particular state.

How gun rights restoration works

People use several different names for this. A pardon, an expungement, a set-aside, and relief from disabilities are not the same thing.

Which ones exist, who decides them, and what they change depend on your state and on federal law. This is a general description, not the law of any state.

Pardon

A pardon is an act of forgiveness by a government official, often a governor or a president.

What a pardon changes depends on that government. It may or may not affect a firearm disability.

Expungement

Expungement usually means a court seals or clears a record. States use different names and different rules for this.

Clearing a record in one state does not by itself answer a federal firearm question.

Set-aside

Some states let a court set aside a conviction. That is not the same as a pardon or an expungement.

The effect on firearm rights depends on that state's law and on federal law.

Relief from disabilities

A separate federal process lets some people ask the U.S. Department of Justice for relief from a federal firearm disability.

The Department decides each request, and a grant, if one is issued, does not remove state or tribal prohibitions.

Rights Restore helps you organize and prepare materials for that process. It does not file them, and it does not decide the request.
